In North Carolina, guardianship is the result of a proceeding in front of the Clerk of Superior Court wherein an adult (or minor who has attained the age of 17 1/2) is determined to be unable to manage his or her own finances or health care because of some mental or physical issue. When some lacks the ability to make their own decisions, everything comes to a stop. That person cannot consent to medical decisions, manage their finances, or advocate for their own needs. A guardian is necessary to step into the impacted person’s shoes and make decisions on their behalf.
